Terms of Service

Welcome to Tip Tag! These Terms of Service ("Terms") govern your access to and use of the digital tipping service provided by Tip Tag (Pty) Ltd. ("Tip Tag," "we," "us," or "our") via our NFC/QR tags, website, and mobile application (collectively, the "Service").

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST NOT USE THE SERVICE.

1. User Obligations and Eligibility

1.1 Eligibility

You must be at least 18 years old and capable of forming a binding contract with Tip Tag. If you are a Service Worker (Tippee), you must undergo and pass our required identity and banking verification processes.

2. The Digital Tipping Service

2.1 Role of Tip Tag

Tip Tag acts solely as a technology provider and facilitator of digital tip transactions between the Tipper (Customer) and the Tippee (Service Worker). We are not a bank, payment processor, or financial institution. We rely on third-party payment gateways for fund handling and settlement.

2.2 Tip Settlement and Fees

Tips collected are subject to a Commission Fee deducted by Tip Tag to cover operational costs, payment gateway fees, and maintenance. The final net tip amount will be settled to the Service Worker's provided bank account or digital wallet, subject to [Daily/Weekly/Monthly] settlement schedules and minimum withdrawal thresholds.

*Tip Tag's current Commission Fee is 6% per transaction. Fees are subject to change upon 30 days' notice.*

3. Account Management and Security

3.1 Account Verification

Service Workers must provide accurate and complete personal identification and banking information necessary for verification and compliance with applicable South African financial regulations (e.g., FICA/AML). Failure to pass verification may result in account suspension and tip retention until resolved.

3.2 Security

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify Tip Tag immediately of any unauthorized use or security breach.

4. Disclaimers and Limitation of Liability

4.1 Service Availability

Tip Tag does not guarantee that the Service will always be available, uninterrupted, timely, secure, or error-free. The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

4.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TIP TAG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.

5. Termination

Tip Tag reserves the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

6. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of The Republic of South Africa.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration in Johannesburg, South Africa.

7. Changes to the Terms

We reserve the right to modify these Terms at any time. If we make changes, we will notify you by revising the effective date at the top of the Terms. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
